Wage and Hour Update

The mortgage brokerage industry has been hit with a variety of U.S. Department of Labor (DOL) enforcement actions and class action litigation since the DOL's revised federal regulations governing overtime went into effect in August 2004. Most of these enforcement action and cases involve the misclassification of workers as exempt from the Fair Labor Standards Act (FLSA) minimum wage and overtime requirements. To help clarify these issues NAMB recently secured from DOL an Opinion Letter on the outside sales exemption for loan officers/originators. Outside Sales employees are exempt from both the minimum wage and overtime requirements of the FLSA. The Outside Sales exemption is the only FLSA exemption under which employers lawfully can pay qualifying employees on a true commission-only basis (no minimum wage or salary requirement). Attend this important session to learn about how you may be able to protect your business against wage and hour violations by understanding and complying with FLSA requirements and specifically, the Outside Sales exemption for qualifying employees.
